Terms of Service

1. Description of Service

HUAYU DIANA Publisher is a web-based video publishing tool that allows registered users to:

• Connect their personal TikTok account via TikTok's official OAuth 2.0 authorization flow;
• Upload video files (up to 500 MB) to our servers;
• Instruct the Service to publish those videos to TikTok asynchronously in the background;
• Receive email notifications upon successful publishing or failure.

The Service acts as a publishing interface on your behalf. We do not edit, moderate, or take ownership of any content you publish.

2. Eligibility

• You must be at least 18 years old to create an account and use the Service.
• You must have a valid, active TikTok account.
• You must provide a valid email address and complete email verification before publishing.
• By registering, you represent and warrant that all information you provide is accurate and complete.

3. Account Registration and Security

• You are responsible for maintaining the confidentiality of your account credentials (email and password).
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access at support@huayu.ltd.
• We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or used in violation of these Terms.

4. TikTok Authorization

By connecting your TikTok account through our OAuth flow, you explicitly authorize HUAYU DIANA Publisher to:

• Retrieve your TikTok display name and avatar for dashboard display purposes (user.info.basic);
• Upload video files to TikTok's servers on your behalf (video.upload);
• Publish videos to your TikTok profile on your explicit instruction (video.publish).

You may revoke this authorization at any time by disconnecting your TikTok account in the Service settings, or by visiting TikTok's connected apps settings. Revoking authorization will prevent future publishing but will not delete your HUAYU DIANA Publisher account or history.

Your use of TikTok through our Service is also subject to TikTok's Terms of Service and Community Guidelines.

5. User Responsibilities and Acceptable Use

You are solely responsible for all content you upload and publish through the Service. You represent and warrant that:

• You own or have all necessary rights, licenses, and permissions to publish the content;
• The content does not infringe any third party's intellectual property, privacy, or publicity rights;
• The content complies with all applicable laws and TikTok's Community Guidelines;
• You will not use the Service to publish content that is defamatory, harassing, hateful, sexually explicit, or otherwise harmful.

Prohibited Uses

You may not use the Service to:

• Publish spam, misleading content, or automated bulk posts;
• Circumvent TikTok's rate limits, publishing restrictions, or content policies;
• Distribute malware or conduct phishing attacks;
• Attempt to gain unauthorized access to any system or account;
• Resell or sublicense access to the Service without our written consent.

6. Content Ownership

You retain full ownership of all video content you upload. By using the Service, you grant HUAYU DIANA Publisher a limited, temporary license to store and transmit your content solely for the purpose of fulfilling the publish job you requested. This license terminates automatically when the job is completed or the file is deleted.

7. Service Availability and Limitations

• The Service is provided on a best-effort basis. We do not guarantee 100% uptime or error-free operation.
• Publishing success depends on TikTok's API availability, which is outside our control. We are not responsible for publishing failures caused by TikTok-side API outages, content moderation rejections, or changes to TikTok's platform policies.
• Maximum video file size is 500 MB per upload.
• We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice where practicable.

8. Account Termination

You may delete your account at any time via the Data Deletion page. Deletion is permanent and removes all your data including your TikTok connection, publish history, and account credentials.

We reserve the right to suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or if required by law.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation, or, if necessary, through binding arbitration.
